Abstract
Law 3/2018 of June the 11th modifies Law 23/2014 of November the 20th, about mutual recognition of criminal resolutions in the EU, to regulate the European Investigation Order. The Law 3/2018 transposes to our legal system the Directive 2014/41/EU of the European Parliament and the Council of April the 3rd 2014, relative to the European Investigation Order in criminal matters. The purpose of this paper is focusing on analysing why the Spanish authorities denies an EIO that requires specific research measures as planned in the current drafting of Law 23/2014, highlighting its specific regulation it brings about a breach of the principle of mutual recognition in the matter of evidences, and demonstrates the distrust among the Member States in criminal judicial cooperation.
