Abstract

This paper addresses two problems relating to the enthymemes (understood as incomplete arguments) made in criminals procedures to support the truth of factual statements: (1) How can a legal interpreter justify the attribution of certain claims to a text that does’nt contain it?, and (2) How can choose the unstated premises to incorporate into the reconstruction when the text admits more than one interpretation? Two kinds of deductivists answers (naive and sophisticated) to that questions are rejected because are not being able to respond to its critics while maintaining its commitment to deductive logic. We propose an interpretive model as alternative, based on the adoption of the principle of charity and other pragmatic standards, capable of retaining the virtues of the logical approaches to the enthymemes but without sharing its deficiencies. Finally, we test our proposal by applying it to an example of enthimematic evidenciary argumentation, using as a guide and justification for the incorporation of the unstated premises an argument scheme of the type «inference to the best explanation».
