Abstract

The recent case-law of the Spanish Supreme Court has discussed about the horizontal direct effect of some Directives. Particularly the Working Time and the Collective Dismissals Directives. In this paper it is developed a critical assessment about this case-law which prompts a broader reflection about the footprint of the EU Social Policies in the Spanish Labour Law. The recent judgments of the ECJ have shown various inconsistencies between the national Law and some Directives. It is needed to solve them through the appropriate legislative changes. However and meanwhile it is important for Spanish judges and courts to use the established criteria with the aim to give effect, if possible, to the poorly transposed Directives. Nonetheless, and in the author’s opinion, the Supreme Court has put very little effort in this objective
