Abstract

The new Patent Act establishes a specific regime to regulate the ownership on inventions proceeding from public research centers. In this paper, we analyze that specific regime, under which ownership of the invention is assigned to the public research center. It also analyzes researcher’s rights and duties, specifically his right to participate in the benefits derived from the exploitation of the invention.
