Resumo

The British labour relations system distinguishes itself by the collective laissez-faire in which workers’ representatives have played an important role in the adoption of agreements regulating labour conditions in companies. The union representation crisis in the United Kingdom has its origin in the dismantling of the collective rights that has been carried out by the different liberal norms and policies of the governments. The decentralization of collective bargaining in English labour relations, with a clear reflection in the reduction of sectoral agreements, fundamentally responds to the decrease in the union density rate, the more limited number of unions recognized for negotiation and in the number of shop stewards. Together with the restrictive reform on the law of the right to strike, which the government itself contemplates as an attack on free market competition, it sharpens the individualization of labour rights with consequent lack of protection for workers, especially in the context of the Brexit. However, given the globalized socioeconomic reality, it needs to be assessed if any of these devastating perspectives is perceptible in our legal system or the risk of contagion in the near future. could be agreed by collective agreements
