Abstract
: The protection afforded to fundamental rights in the workplace can be seen in a specific procedure that is characterized by the summary, preference, intervention of the Public Prosecutor and reversal of the burden of proof. An example of such greater protection granted by the legal order to fundamental rights is the possibility of qualifying the dismissal as void that entails the readmission of the worker. It is also possible to claim actual damages, which should take into account concepts such as loss of profits and emerging damage.
