Résumé
Until the adoption of the national and regional legislation in the field of family mediation, the resolution of conflicts arising from marital crises had be solved in the judicial field. Mediation is a process in which the parties voluntarily try to establish the terms of their divorce by mutual agreement, seeking to reduce the emotional harm arising from the separation or divorce, to protect the interests of minors who may be involved and to minimize the disagreements of the spouses. In this paper we analyse, in particular, the compensatory pension as an object of the mediation process, highlighting the controversial aspects of this element of the divorce and the possible solutions to be achieved through mediation.
