Abstract

Traffic Accidents (ACVMs) involve the death of approximately 4000 persons in Spain a year and wounds of diverse consideration in approximately 145.000 (Dirección Genaral de Tráfico, 2006). Mental injury or emotional suffering of the victims of these accidents has to be repaired by an economic compensation, which runs usually at the expense of the insurance company of the causative vehicle of the accident. Evidently, major all that is the hurt, major has to be the economic compensatory quantity. So that, simulation is a hypothesis to checking in this context, before to the quantification of the hurt. For the measure of the hurt and of simulation it is appealed generally to the MMPI-2. Results of 150 subjects under instructions of simulation showed that the measures standard of simulation and the measures standard more the additional ones (Fp and Ds) would detect, without the commission of error type II, not admissible in the forensic practice, for the equal one the simulation, 54 %. Results are discussed for the forensic establishment of protocols of evaluation of the moral hurt.
