Zusammenfassung
This paper analyses the importance of assessing situations of lack of protection of minors, not only by the administrative bodies, which must qualify the different situations and decide on the specific intervention measures to be applied, but also by the judicial bodies, which must resolve the claims and appeals filed by parents in disagreement against administrative decisions or court rulings. LO 8/2021 has significantly improved the regulation of the risk indicators which, precisely, facilitate the correct assessment of the situations examined, which are very diverse, as reflected in the latest judicial decisions on the matter, which are briefly examined.
