Principios de la Justicia Terapéutica: Un análisis de la dimensión 4 del CENITJ en personas privadas de libertad

Abstract

From the perspective of Therapeutic Jurisprudence (TJ), the knowledge generated by behavioral and health sciences is considered important. In particular, the principles of adherence and relapse prevention, pose interesting applications in the justice system. The relationship between officials and users of the system can promote the understanding and the participation of the latter in the formulation of agreements, measures, sanctions or any other conclusions reached in the legal procedure. In order to know the perception of the population deprived of liberty on the interaction they had with officials during their processes, the Questionnaire for the Evaluation of the Level of Implementation of the Therapeutic Jurisprudence in the Justice System (Cuestionario para la evaluación del nivel de implementación de la TJ en el Sistema de Justicia, CENITJ) was applied, specifically in its dimension four, which evaluates the application of these therapeutic principles. The responses of 216 Argentine nationals deprived of liberty indicated that the way in which judicial authorities interact with people prosecuted is far from what the TJ establishes. They perceived a lack of empathy and no contribution to the reduction of conflict situations. Furthermore, proposals for alternatives are not requested to resolve their cases, nor information on the circumstances that may increase the risk of recidivism, or on the protective factors related to family and social support for adherence or compliance with the sentence. In addition, men and women have different perceptions regarding their motivation to participate in the processes and decisions that involve their cases, with a more positive perception from women, although in neither case the expected levels from TJ are achieved. Based on the results, the need for more training in TJ of the judicial authorities is raised, specifically regarding the importance of motivating and giving a voice to the users of justice.
