La progresiva ecologización del derecho internacional de los cursos de agua. Manifestaciones convencionales, jurisprudenciales y consuetudinarias

Resumo

En la evolución más reciente de la regulación de las masas de agua dulce transfronterizas puede identificarse una progresiva influencia de los desarrollos que se han producido en el derecho internacional del medio ambiente. Se trata de un fenómeno al que podemos calificar de “ecologización” del derecho de los cursos de agua internacionales y en el cual los enfoques ecosistémicos y cuestiones conexas como el mantenimiento de caudales ecológicos constituyen algunas de sus expresiones más novedosas.  Este trabajo ofrece una identificación de las principales manifestaciones convencionales, jurisprudenciales y consuetudinarias de esta tendencia.
