Abstract

This study aims to explore the situation of EU border citizens residing in one Member State and moving to another Member State to work as an employee. It analyses contextual and conceptual issues, the competent court and the law applicable to the employment contract. And, more comprehensively, through the case law of the CJEU, it examines some of the obstacles to their free movement, mainly differences in treatment based on residence criteria in terms of social advantages and social security benefits.
