Abstract

In ancient Rome, women did not enjoy a situation of a complete freedom, because of being born as a women, they lacked the privileges of a man, the main leading figure of family legal relationships. It is important to know the different forms of potestas to which they were subjected in order to understand their legal situation to focus, finally, on an institution that was an inexcusable part of the life of women for a long time, the mulierum guardianship. It was considered essential to protect a sex, which was thought to be weak in a patriarchal system, in a discriminatory system because of sex like the Roman one, was present in the legal space of women for several centuries, until becoming a declined instrument, but it was never abolished to avoid the recognition of its real irrelevance.
