Resum

este trabalho aborda o valor jurídico e prático que pode chegar a ter o projeto de artigos sobre o direito dos aquíferos transfronteiriços da CDI, sobre o qual não parece previsível que se vá a adotar uma convenção a curto prazo. Para isto, toma-se como referência o estudo do valor jurídico e prático que têm tido outros trabalhos da CDI que não têm chegado a se converter em uma convenção internacional em vigor. Esta análise nos permite apreciar que sua aplicação prática depende não tanto de sua forma, mas do valor jurídico de seu conteúdo, é dizer, de sua natureza consuetudinária ou de desenvolvimento progressivo; e, neste último caso, de sua capacidade para gerar novas costumes internacionais através de sua aceitação pelos Estados.
