Resumo

El presente artículo se centra en la organización de la responsabilidad parental tras la ruptura de pareja, las consecuencias que ésta tiene sobre los hijos y, en especial, la custodia compartida. Se introduce la justicia terapéutica (TJ) como el paradigma pertinente para llevar a cabo modificaciones de las normas legales, los procedimientos judiciales y la actuación de los profesionales que intervengan en el caso con objeto de facilitar que la gestión de la ruptura de la pareja permita llevar posteriormente una corresponsabilidad parental de forma positiva, centrada en el bienestar de los hijos.
