Resumo

This paper provides an analysis of the amendments introduced by Law 15/2015, of Voluntary Jurisdiction of 2nd July, paragraphs 1, 2 and 3 of article 756 CC, which regulate the causes of unworthiness to inherit. It is worth noting that legislative changes seek to reform this legal institution and its adaption to the new social reality. Therefore, the legislators have included new instances causing to be debarred from succession and have proceed to the revision and legal update of the text. However, as it will be revealed, the current content is subject to certain legislative inconsistencies which complicate its application and, moreover, the regulation changes are insufficient to achieve the purpose of this figure: the failure to success in the heritage of the cause/causal agent who commits the acts described in the precept
