Abstract

With the present work of investigation we try to do an analysis of the birth and the juridical classic evolution of the actio in rem versio. In effect, though the pretorian action was born combined to the actio of peculium in the same formula, nevertheless both actions gave place to two parallel and simultaneous processes that were solved of independent form. In addition, the impressive and free game of the managerial and mercantile traffic during the Empire made possible that the actio de in rem versio turn it was possible to exercise in a way independent from that one. Finally, the praetor and the classic jurisprudence have emphasized that the action enjoys a juridical own, nature substantive and independent from the action of peculiu.
