Abstract

There are many breaches that may violate the requirements of good faith in the field of labor relations. The violation of contractual good faith may justify the disciplinary dismissal of the employee in the case of very serious offences. She can not pretend that the alleged breach are considered as not accredited if she could have made allegations and provided evidence to counter the reports and evidence of the complaining in the context of a disciplinary proceeding and in the subsequent trial, when the judge “a quo” has properly assessed those facts and evidence.
