Resumo

The aim of the research is to analyze the consistency of the scientific doctrine of judicial decisions regarding the illegal trafficking labour .To do this, we will study the current laws, the state of the doctrine and criminal judgments in the matter. The methodology used was documentary research. Techniques for the analysis are as follows: Firstly, content analysis, and secondly, we used the analysis of scientific documents and legal regulations. A total of 16 sentences were tested, of which, for our analysis, 14 were useful, and the last sentence available from 2009. So we draw on the most recent charge (2011) to confirm whether it still uses the same line of interpretation.As a result, we obtain that Doctrine, Judges and Courts agree in that the Penal type protects the indemnity of the employment relationship, but for the Doctrine the nuclear verb of the Penal type is traffic thus they understand that the placement of the legal mechanisms margins for the illegal recruitment and assignment of the employees, whilst Judges and Courts consider that the principal conduct is the exploitation.
