Abstract

Consumer Arbitration is presented as an alternative mechanism that helps to guarantee the defense of consumer rights. This system has been adopted in several countries, in the search to protect this vulnerable sector of society. This thesis develops a study of the legal protection of consumer law and the proposal to implement the Spanish consumer arbitration system in Ecuadorian legislation, as an effective means of out-of-court conflict resolution between consumers and businessmen, which allows access from consumers and users to the Ecuadorian justice. For this, he used the traditional dogmatic method, with the application of inherent methodologies of qualitative research. As a result, viable proposals for the implementation of this system in Ecuador stand out, taking into account the current situation of the legal protection of the consumer with the recent reforms to the law.
