Resumo
The processes of breakup of a couple with children can present and reach high levels of conflict, even leading to the establishment of real «power struggles» between the parents, mainly over the custody of the children, which is further aggravated when one of the parents seeks to confront the child with the other parent. This type of negative influence has been tried to be integrated into the controversial Parental Alienation Syndrome. However, this syndrome has been the subject of extensive debate both at doctrinal and jurisprudential level, although the recent Organic Law 8/2021, of June 4, on the comprehensive protection of children and adolescents against violence, brings about a change by including it within the theoretical approaches or criteria without scientific backing in which adult interference or manipulation is presumed.
