Abstract

The debate about labour protection of pregnant women does not settle this Constitutional Court decision, since it raises an interesting consideration about the anti-discrimination protection of pregnant workers in the event that their employment contract is resolved during the testing period. The question that arises is whether it is possible to extend the protection to these cases provided in the art. 55.5 b) of the Workers’ Statute provided in case of dismissal, or whether they are different institutions such large protection is not possible.
